The Supreme Court has repeatedly affirmed that parental rights constitute a fundamental liberty interest protected by the Fourteenth Amendment's Due Process Clause. In Meyer v. Nebraska (1923), the Court recognized "the right of parents to control the education of their own" as among the liberties protected by the Constitution. Two years later, Pierce v. Society of Sisters (1925) struck down Oregon's compulsory public education law, declaring that "the child is not the mere creature of the State; those who nurture him and direct his destiny have the right, coupled with the high duty, to recognize and prepare him for additional obligations."

More recently, Troxel v. Granville (2000) reaffirmed that "the interest of parents in the care, custody, and control of their children is perhaps the oldest of the fundamental liberty interests recognized by this Court." Yet despite this unambiguous constitutional heritage, state governments have systematically dismantled parental authority through eight distinct categories of violations.
